1. ABOUT THESE TERMS
These Terms & Conditions apply to the hire of party, entertainment and related equipment from SugarFix.
By making a booking, paying for a booking, accepting delivery or taking possession of SugarFix equipment, the customer agrees to these Terms & Conditions.
The customer may be a private individual, business or other organisation.
These Terms apply together with the customer's booking confirmation, quotation and any specific written arrangements agreed between SugarFix and the customer.
If there is an inconsistency between these Terms and a specific written agreement issued by SugarFix for a booking, the specific written agreement will apply to the extent of the inconsistency.
2. DEFINITIONS
Customer means the person or organisation making the booking.
SugarFix means SugarFix and its authorised representatives.
Equipment means any equipment, accessories, items or other property supplied by SugarFix for hire.
Hire Period means the period stated in the customer's booking confirmation.
Hire Fee means the amount payable for the equipment and services included in the booking.
Booking Payment means any amount paid to confirm or secure a booking.
Security Deposit means any refundable deposit required by SugarFix for the booking.
Peace of Mind Cover means the optional customer protection product offered by SugarFix for qualifying accidental damage.
Business Day means a day other than a Saturday, Sunday or public holiday in the applicable operating state.
3. BOOKINGS
A booking is confirmed when SugarFix has accepted the booking and the required payment has been received.
SugarFix may require the customer to provide:
Full name
Business or organisation name, where applicable
Phone number
Email address
Delivery address
Identification or other information reasonably required to verify the booking
Any other information reasonably required to provide the hire
A booking is not considered confirmed until SugarFix has confirmed acceptance.
SugarFix may decline a booking where there is a reasonable business, safety, availability or compliance reason for doing so.
4. HIRE PERIOD
The applicable Hire Period will be stated in the customer's booking confirmation.
The customer must make the Equipment available for collection at the agreed collection time and location.
Equipment must not be retained beyond the agreed Hire Period without SugarFix's approval.
Additional hire days may be available subject to equipment availability and applicable additional-day charges.
Keeping Equipment beyond the agreed period without approval may result in additional charges and may affect SugarFix's ability to fulfil another customer's booking.
5. HIRE FEES AND PAYMENT
The customer must pay the Hire Fee stated in the booking confirmation.
SugarFix may accept the payment methods displayed or otherwise communicated at the time of booking, including:
Direct bank transfer
Square
PayPal
Other payment methods approved by SugarFix
Unless otherwise agreed, the booking must be paid in full before the hire commences.
Any applicable Security Deposit and optional Peace of Mind Cover will be disclosed before booking confirmation.
The customer is responsible for ensuring that payments are made by the required due date.
6. SECURITY DEPOSIT
SugarFix may require a refundable Security Deposit.
The standard Security Deposit is based on the total booking value:

SugarFix may require a higher Security Deposit where a booking involves unusually high-value equipment, an extended hire period or circumstances presenting an increased level of risk.
Any higher deposit will be disclosed to the customer before the booking is confirmed.
The Security Deposit remains the customer's money unless SugarFix is entitled to retain part or all of it under these Terms.
SugarFix may apply the Security Deposit toward legitimate amounts owed by the customer, including:
Customer-caused equipment damage
Lost equipment
Missing equipment
Missing accessories
Extraordinary cleaning caused by misuse
Approved late-return charges
Other reasonable and legitimate amounts payable under the booking
The Security Deposit will not be used for:
Normal wear and tear
Ordinary cleaning
Pre-existing damage
Equipment failure or defect not caused by the customer
Amounts SugarFix is not legally entitled to recover
After collection, SugarFix will inspect the returned Equipment.
Where a deduction is required, SugarFix may retain the relevant amount while the issue is assessed and evidence is obtained.
The customer will be notified of any material deduction.
Subject to any unresolved damage, loss or other legitimate claim, the remaining Security Deposit will be refunded or released within 10 Business Days following completion of the return inspection.
Where further time is reasonably required to determine the cost of damage, repair or replacement, SugarFix will notify the customer.
7. CANCELLATION BY THE CUSTOMER
The customer may cancel a booking by notifying SugarFix.
Cancellation charges are intended to reflect the timing of the cancellation, reasonable costs incurred by SugarFix and any genuine unrecovered loss.
SugarFix will make reasonable efforts to minimise any loss, including attempting to re-hire Equipment where practical.
More than 7 days before hire
The customer will generally receive a full refund, less any genuine non-refundable costs specifically incurred for the booking.
3–7 days before hire
The customer will generally receive approximately 75% of the amount paid, with the remaining amount retained to account for administration, payment costs, preparation and other reasonable business costs associated with the cancellation.
Where SugarFix successfully re-hires the Equipment for the same period, the amount retained may be reduced and a refund of up to approximately 90% may be provided, less reasonable administration or unrecovered costs.
Within 48 hours of hire
The customer will generally receive approximately 50% of the amount paid, reflecting the significantly greater preparation, scheduling and business impact associated with a late cancellation.
Where SugarFix successfully re-hires the Equipment for the same period, the refund may increase to approximately 90%, less reasonable administration or unrecovered costs.
Cancellation and Consumer Rights
The above cancellation arrangements do not limit any rights the customer has under the Australian Consumer Law or other applicable legislation.
SugarFix will not impose a cancellation charge where doing so would be inconsistent with a customer's non-excludable legal rights.
8. CANCELLATION BY SUGARFIX
SugarFix may cancel a booking where it cannot reasonably provide the agreed Equipment or service, including because of:
Equipment failure
Safety concerns
Unforeseen circumstances
Equipment being unavailable
Events outside SugarFix's reasonable control
Customer information being materially incorrect
A serious compliance or safety concern
Where SugarFix cancels a booking for a reason within SugarFix's responsibility, SugarFix will provide the remedy required by law.
Where reasonably possible, SugarFix may attempt to provide suitable replacement Equipment or an alternative arrangement.
Nothing in this clause limits the customer's rights under the Australian Consumer Law.
9. DELIVERY
Where delivery is included in the booking, SugarFix will deliver the Equipment to the agreed address within the agreed delivery arrangement.
The customer must ensure:
The delivery address is accurate.
Safe access is available.
Someone authorised to accept the Equipment is available where required.
Any relevant access restrictions are communicated before delivery.
The delivery area is reasonably safe.
SugarFix may require the customer to provide additional information where access is difficult, restricted or otherwise unsuitable.
Delivery charges are determined by SugarFix's current pricing structure and will be disclosed before booking confirmation.
10. COLLECTION
The customer must have all hired Equipment ready for collection at the agreed time.
Equipment should be:
Accessible
Together in one location where reasonably possible
Free from unnecessary rubbish or personal items
Ready for inspection
Packed or positioned in accordance with any instructions provided by SugarFix
Failure to make Equipment available may result in additional collection or hire charges where reasonably incurred.
11. CUSTOMER RESPONSIBILITY FOR EQUIPMENT
The customer is responsible for taking reasonable care of the Equipment while it is in their possession.
The customer must:
Use the Equipment only for its intended purpose.
Follow SugarFix instructions.
Follow manufacturer instructions where provided.
Keep Equipment in a safe environment.
Prevent unauthorised persons from using Equipment where appropriate.
Protect Equipment from avoidable damage.
Report faults, damage or safety concerns promptly.
Stop using Equipment if continued use could create a safety risk.
The customer must not:
Modify Equipment.
Attempt unauthorised repairs.
Remove safety devices.
Tamper with electrical components.
Use Equipment for a prohibited purpose.
Deliberately damage Equipment.
Use Equipment recklessly.
Allow Equipment to be used in an unsafe manner.
12. EQUIPMENT CONDITION
SugarFix will provide Equipment that is reasonably clean, functional and suitable for the agreed hire purpose.
Equipment may show reasonable signs of previous use.
Normal wear and tear is not customer damage.
Where appropriate, SugarFix may record the condition of Equipment before and after hire.
Pre-existing damage will not be charged to the customer.
13. DAMAGE, LOSS AND MISSING ITEMS
The customer may be responsible for reasonable costs arising from damage, loss or missing items caused by the customer's actions or failure to take reasonable care.
This may include:
Accidental customer-caused damage
Damage caused by misuse
Damage caused by negligence
Reckless damage
Deliberate damage
Lost Equipment
Stolen Equipment
Missing accessories
Unauthorised modifications
Extraordinary cleaning caused by misuse
SugarFix will not charge the customer for:
Normal wear and tear
Pre-existing damage
Equipment failure not caused by the customer
Manufacturing defects
Faults arising from normal operation
Ordinary cleaning required after normal use
Any amount claimed by SugarFix will be reasonable and connected to the actual loss, repair, replacement or other legitimate cost incurred.
SugarFix may use photographs, inspection records, repair quotations, invoices or other reasonable evidence when assessing damage.
14. THEFT AND LOSS
The customer is responsible for taking reasonable care of SugarFix Equipment while it is in their possession.
If Equipment is stolen or lost during the Hire Period, the customer must notify SugarFix as soon as reasonably possible.
The customer may be responsible for the reasonable replacement cost or other actual loss where the loss resulted from the customer's failure to take reasonable care, negligence, misuse or other circumstances for which the customer is legally responsible.
Peace of Mind Cover does not automatically cover theft or loss unless expressly stated otherwise in the booking.
15. EXTRAORDINARY CLEANING
Normal cleaning is included in the hire service.
SugarFix may charge reasonable cleaning costs where Equipment requires cleaning substantially beyond normal post-hire cleaning because of:
Misuse
Excessive contamination
Spills or substances outside normal use
Deliberate contamination
Failure to follow cleaning instructions
Other avoidable customer-caused conditions
Charges will be based on the reasonable cost of restoring the Equipment to a hire-ready condition.
16. PEACE OF MIND COVER
SugarFix may offer optional Peace of Mind Cover at the time of booking.
Peace of Mind Cover is an optional customer protection product and is separate from SugarFix's own business insurance.
It is not intended to replace the customer's responsibility to take reasonable care of hired Equipment.
Cover Fee
The Peace of Mind Cover fee is:
15% of the applicable booking/hire amount, subject to a minimum charge of $10.
The applicable amount will be shown before booking confirmation.
Maximum Protection
The maximum protection provided under Peace of Mind Cover is:
$1,000 per booking.
Qualifying Damage
Subject to the exclusions below, Peace of Mind Cover may reduce the customer's financial responsibility for genuine accidental damage occurring during the approved Hire Period.
Customer Contribution
Where qualifying accidental damage occurs, the customer's contribution will be:
15% of the assessed eligible damage cost, subject to a minimum contribution of $10.
The customer's contribution will not exceed the applicable $1,000 protection limit.
Damage Above $1,000
Where eligible damage exceeds $1,000, the $1,000 maximum protection applies.
The Peace of Mind Cover fee already paid by the customer will also be taken into account when determining the amount ultimately payable by the customer for the eligible damage.
The customer will not be charged twice for the same amount.
Examples
If eligible accidental damage is assessed at $200:
Customer contribution = $30.
If eligible accidental damage is assessed at $50:
Customer contribution = $10 minimum.
If eligible accidental damage is assessed at $1,500:
The $1,000 maximum protection applies, with the Peace of Mind Cover fee already paid also taken into account when calculating the customer's remaining liability.
Exclusions
Peace of Mind Cover does not apply to:
Theft
Loss
Missing Equipment
Missing accessories
Deliberate damage
Reckless behaviour
Intentional misuse
Prohibited use
Unauthorised modification
Unauthorised repair
Damage occurring outside the approved Hire Period
Damage to consumables
Damage caused by failure to follow reasonable safety instructions
Damage arising from conduct for which the customer would otherwise be responsible beyond the scope of accidental damage
SugarFix may assess whether damage qualifies for Peace of Mind Cover.
Customers must report damage promptly and provide reasonable information about what occurred.
Peace of Mind Cover does not limit any rights the customer has under Australian Consumer Law.
17. EQUIPMENT FAILURE
If Equipment stops working or appears unsafe during the Hire Period, the customer must contact SugarFix as soon as possible.
The customer must not attempt unauthorised repairs.
SugarFix may provide troubleshooting assistance where appropriate.
Depending on the circumstances, SugarFix may:
Provide remote troubleshooting.
Arrange technical assistance.
Replace the Equipment.
Provide alternative Equipment.
Extend the Hire Period.
Provide an appropriate refund or credit.
Take another reasonable action to resolve the issue.
Where Equipment fails due to a fault or defect not caused by the customer, the customer will not be charged for the resulting Equipment damage.
Any refund, replacement or other remedy will be handled in accordance with the circumstances and the customer's legal rights.
18. PARTY RESCUE GUARANTEE
SugarFix aims to provide reliable Equipment and support when customers need it.
Where a significant Equipment failure occurs during a hire and the failure is not caused by the customer, SugarFix will make reasonable efforts to provide a suitable solution.
This may include troubleshooting, replacement Equipment, alternative Equipment, an extension, refund or other appropriate remedy.
The Party Rescue Guarantee does not replace or limit the customer's rights under Australian Consumer Law.
SugarFix cannot guarantee that identical replacement Equipment will always be available.
19. FOOD AND CONSUMABLES
Where consumables are supplied by SugarFix, they will generally be commercially manufactured products supplied in their original packaging.
The customer is responsible for using consumables in accordance with the manufacturer's instructions and any SugarFix instructions provided.
SugarFix does not manufacture, prepare or represent itself as a catering provider merely because consumables are supplied with Equipment hire.
Consumables are generally non-returnable once opened or used, except where otherwise required by law.
Customers are responsible for notifying SugarFix of any known allergy or dietary concern before purchasing consumables.
SugarFix does not guarantee that consumables are suitable for a particular dietary requirement unless that suitability has been expressly confirmed.
20. ELECTRICAL EQUIPMENT
Electrical Equipment must be used in accordance with:
SugarFix instructions
Manufacturer instructions
Applicable electrical safety requirements
Any instructions supplied with the Equipment
Customers must not:
Modify electrical Equipment.
Remove plugs or electrical safety devices.
Use damaged leads or plugs.
Expose Equipment to water unless specifically designed for such use.
Overload electrical circuits.
Use Equipment in conditions for which it was not designed.
If an electrical fault occurs, the customer must stop using the Equipment and contact SugarFix.
21. CUSTOMER INSTRUCTIONS
SugarFix may provide written or verbal instructions for Equipment.
Customers are responsible for ensuring that users of the Equipment understand relevant operating and safety instructions.
Where Equipment requires specific operating procedures, SugarFix may require the customer to acknowledge receipt of those instructions.
Failure to follow instructions may affect the customer's responsibility for resulting damage, subject to applicable law.
22. LATE RETURNS
Equipment must be returned or made available for collection at the agreed time.
If Equipment is returned late without SugarFix's approval, SugarFix may charge the applicable additional hire rate and reasonable costs arising from the delay.
Where a late return affects another confirmed booking, SugarFix may also seek reasonable losses that are legally recoverable.
Late-return charges will not be used as a penalty.
23. CUSTOMER PROPERTY
SugarFix is not responsible for personal property left inside or with hired Equipment unless responsibility arises under applicable law.
Customers should remove all personal property before collection.
Where SugarFix finds customer property, it may attempt to contact the customer.
Unclaimed property may be dealt with in accordance with applicable law.
24. DELIVERY ACCESS AND PROPERTY DAMAGE
The customer is responsible for providing accurate information about access conditions.
The customer should advise SugarFix before delivery of:
Stairs
Narrow access
Difficult terrain
Restricted access
Apartment access requirements
Parking restrictions
Other conditions that may affect delivery
SugarFix will take reasonable care when delivering and collecting Equipment.
The customer must not require SugarFix personnel to undertake unsafe delivery activities.
25. CUSTOMER RESPONSIBILITY FOR USERS
The customer is responsible for ensuring that people using SugarFix Equipment are appropriately supervised and instructed.
Where Equipment is intended for use by children, the customer remains responsible for appropriate supervision.
The customer must ensure that Equipment is not used in a way that creates an unreasonable safety risk.
26. PROHIBITED USE
SugarFix Equipment must not be:
Used for an unlawful purpose.
Used outside its intended purpose.
Modified without written approval.
Used in dangerous conditions.
Used in a way that creates an unreasonable risk of injury.
Used after a known safety fault has been identified.
Sub-hired, sold, lent or transferred to another person without SugarFix approval.
27. SUB-HIRING AND TRANSFER
The customer must not sub-hire, sell, transfer or otherwise provide SugarFix Equipment to another person or business without SugarFix's written approval.
The original customer remains responsible for the Equipment unless SugarFix agrees otherwise in writing.
28. BUSINESS CUSTOMERS
These Terms may apply to both consumers and business customers.
Where a business customer is a consumer for the purposes of the Australian Consumer Law, applicable consumer guarantees and protections continue to apply.
Nothing in these Terms is intended to exclude, restrict or modify any right that cannot lawfully be excluded, restricted or modified.
29. AUSTRALIAN CONSUMER LAW
SugarFix acknowledges that customers may have rights under the Australian Consumer Law and other applicable legislation.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Mandatory Consumer Guarantee Notice
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
For major failures with the service, you are entitled:
to cancel your service contract with us; and
to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel the service contract and obtain a refund for the unused portion.
You may also have rights relating to goods supplied as part of the hire service, including rights to repair, replacement or refund where applicable.
These rights operate independently of any voluntary protection, guarantee or policy offered by SugarFix.
30. LIABILITY
To the maximum extent permitted by law, the customer is responsible for loss or damage caused by the customer's misuse, negligence, deliberate conduct or failure to comply with these Terms.
SugarFix remains responsible for obligations imposed on it by law, including applicable consumer guarantees.
Nothing in these Terms excludes liability that cannot legally be excluded.
SugarFix will not seek to make a customer responsible for loss caused solely by SugarFix's own failure where the customer has no legal responsibility for that loss.
31. INDEMNITY
To the extent permitted by law, the customer may be responsible for reasonable loss, damage, claims or costs suffered by SugarFix as a result of the customer's:
Deliberate misuse of Equipment
Negligence
Unauthorised modification
Unauthorised sub-hire
Breach of these Terms
Use of Equipment for a prohibited purpose
This clause does not apply to the extent that the loss was caused by SugarFix's own negligence, breach of contract, breach of consumer guarantee or other conduct for which SugarFix is legally responsible.
32. PHOTOGRAPHS AND EVIDENCE
SugarFix may photograph Equipment before and after hire for operational purposes, including:
Condition records
Damage assessment
Maintenance records
Insurance records
Dispute resolution
Where photographs contain personal information or identifiable individuals, SugarFix will handle them in accordance with its Privacy Policy and applicable law.
33. PRIVACY
SugarFix may collect and use customer information necessary to:
Process bookings
Deliver and collect Equipment
Process payments
Communicate with customers
Manage deposits
Manage damage or incidents
Meet legal and regulatory obligations
Operate the business
SugarFix will handle personal information in accordance with its Privacy Policy and applicable privacy laws.
34. COMPLAINTS AND DISPUTES
Customers should first contact SugarFix if they have a complaint or dispute.
SugarFix will make reasonable efforts to investigate and resolve complaints fairly.
Where a dispute concerns Equipment damage, SugarFix may provide relevant information supporting the assessment, such as photographs, inspection records, repair quotations or invoices where appropriate.
Nothing in this clause prevents a customer from exercising rights available under Australian law.
35. CHANGES TO BOOKINGS
Any change to a confirmed booking is subject to Equipment availability and SugarFix approval.
Changes may affect:
Hire price
Delivery charges
Equipment availability
Security Deposit
Peace of Mind Cover
Hire Period
SugarFix will communicate material changes before they take effect where reasonably possible.
36. AVAILABILITY AND SUBSTITUTION
SugarFix will make reasonable efforts to provide the Equipment specified in the booking.
Where unforeseen circumstances make the specified Equipment unavailable, SugarFix may offer suitable replacement Equipment where reasonably possible.
Where a replacement is not reasonably suitable, the customer will receive the remedy required by law.
37. FORCE MAJEURE AND UNFORESEEN EVENTS
SugarFix will not be responsible for delays or inability to perform caused by circumstances outside its reasonable control, including serious weather events, natural disasters, major transport disruptions, government restrictions, serious accidents, utility failures or other extraordinary events.
SugarFix will nevertheless make reasonable efforts to minimise the impact on the customer.
Nothing in this clause removes any legal rights the customer may have.
38. TERMINATION OF A HIRE
SugarFix may require Equipment to be returned immediately where:
Continued use presents a serious safety risk.
The customer is using the Equipment unlawfully.
The customer deliberately damages Equipment.
The customer materially breaches these Terms.
The customer refuses to follow reasonable safety instructions.
Any termination will be handled consistently with applicable law.
39. NO OWNERSHIP TRANSFER
Hiring Equipment does not transfer ownership of the Equipment to the customer.
All Equipment remains the property of SugarFix or its relevant owner.
40. SEVERABILITY
If any provision of these Terms is found to be invalid, unenforceable or unlawful, that provision will be read down or removed to the extent necessary.
The remaining provisions will continue to operate to the extent permitted by law.
41. GOVERNING LAW
These Terms are governed by the laws applicable in New South Wales, Australia.
The parties submit to the courts and tribunals having jurisdiction in that state or territory, subject to any applicable consumer rights.
42. ACCEPTANCE
By confirming a booking with SugarFix, the customer acknowledges that they have had an opportunity to read these Terms & Conditions and agrees to be bound by them.
The customer also acknowledges that:
The Hire Period has been communicated.
The Hire Fee has been communicated.
Any Security Deposit has been disclosed.
Any Peace of Mind Cover fee has been disclosed.
Applicable delivery charges have been disclosed.
The customer is responsible for taking reasonable care of hired Equipment.
The customer has received or will receive relevant Equipment instructions.
43. CUSTOMER SUMMARY
Hire Fee
The amount paid to hire the Equipment.
Security Deposit
A refundable amount held as security for legitimate customer obligations.
Standard deposits:
$50 for bookings up to $149
$100 for bookings from $150–$299
$200 for bookings from $300–$499
$300 for bookings from $500–$749
$500 for bookings of $750+
A higher deposit may apply to unusually high-value, extended or higher-risk bookings and will be disclosed before confirmation.
Peace of Mind Cover
An optional protection product that may reduce the customer's financial responsibility for qualifying accidental damage.
Cover fee: 15% of the applicable booking/hire amount, subject to a $10 minimum.
Maximum protection: $1,000 per booking.
Damage
Customers may be responsible for reasonable costs where damage, loss or missing items are caused by the customer or otherwise fall within the customer's legal responsibility.
Normal Wear and Tear
Normal wear and tear is not charged to the customer.
Equipment Failure
Where Equipment fails through a fault or defect not caused by the customer, SugarFix will work to provide an appropriate solution.
Australian Consumer Law
Nothing in these Terms removes rights that cannot legally be removed.
